Grandparent visitation rights in New Jersey are governed by N.J.S.A. 9:2-7.1, which gives grandparents legal standing to petition the Superior Court for visitation. The law applies whether the family is intact, divorced, or has experienced the death of a parent.

The constitutional dimension matters here. Following Troxel v. Granville (2000) and the New Jersey Supreme Court’s decision in Moriarty v. Brandt, 177 N.J. 84 (2003), courts are required to give significant deference to a fit parent’s decision to limit grandparent contact. Parents retain a constitutional right to direct their children’s upbringing, and that right carries real weight in these cases.

Because of that, the analysis runs in two stages. First, a grandparent must clear a harm threshold: demonstrating by a preponderance of the evidence that denying visitation would cause identifiable harm to the child. Only after clearing that threshold does the court move to a full best-interests analysis. One exception applies: if a grandparent served as the child’s full-time caretaker in the past, that history constitutes prima facie evidence that visitation is in the child’s best interest, shifting the burden in the grandparent’s favor.
