Why Establishing Paternity Matters

Until paternity is legally established, a New Jersey court can’t enter a child support order for a child born to unmarried parents, and a father has no legal basis to request custody or parenting time. Establishing paternity creates the full legal parent-child relationship, with rights and responsibilities running in both directions.

For the child, a legal finding of paternity creates the right to inherit from the father, to be covered under the father’s health insurance, and to receive Social Security benefits as a dependent. For the father, it opens the door to meaningful involvement in the child’s life through custody and visitation orders. Child support for unmarried parents is then calculated under the New Jersey Child Support Guidelines, based on both parents’ incomes and parenting time.

Voluntary Paternity: The Certificate of Parentage

New Jersey law presumes that a child born during a marriage is the legal offspring of the married couple. When parents aren’t married, paternity must be established separately. The most common path is signing a Certificate of Parentage, a form available at the hospital at birth or later through a local registrar or county welfare agency.

A signed Certificate of Parentage becomes a legal finding of paternity unless the signing parent rescinds it within 60 days. After that window closes, the acknowledgment can generally be challenged only on grounds of fraud, duress, or a material mistake of fact. Contested Paternity in the Monmouth County Family Part

When paternity isn’t voluntarily acknowledged, a mother, father, or child may file a paternity complaint. The Family Part of the Monmouth County Superior Court has jurisdiction over these matters, alongside custody, parenting time, child support, and domestic violence cases. The Division of Social Services, the Family Court, and the Probation Department jointly administer the county’s paternity and child support program.

Genetic testing is typically required in contested cases. Under New Jersey law, a test result showing a 95 percent or higher probability of parentage creates a rebuttable presumption that the man is the father. If a man denies paternity at a hearing, the court may order testing and schedule a second hearing once results return.
